Terms of Service

By booking a session or using the services of Dinah Photography (“Photographer”), the Client (“you”) agrees to be bound by the following Terms and Conditions.
1. BOOKING & PAYMENTS
Retainer Fee: A non-refundable retainer fee of 50% is required to secure your session date and time. This fee will be applied toward your total balance.
Final Payment: The remaining balance must be paid in full on the day of the session.
Pricing: Prices are subject to change. However, once a booking is confirmed with a retainer, the price for that specific session is locked.
2. CANCELLATION & RESCHEDULING
Client Cancellation: If you cancel your session, the retainer fee is forfeited.
Rescheduling: Requests to reschedule must be made at least 48 hours in advance. One complimentary reschedule is permitted; subsequent requests may incur a rescheduling fee.
Weather/Force Majeure: If a session cannot take place due to extreme weather or "Acts of God," the Photographer will work with the Client to reschedule at no additional cost.
3. ARTISTIC STYLE & EDITING
Artistic Discretion: Client acknowledges that they have viewed the Photographer’s portfolio and are booking based on the Photographer’s unique style. The Photographer has full creative control over the editing process (color, crop, exposure).
Retouching: Standard editing is included. Extensive "beauty retouching" (e.g., body slimming, background removal) may incur an additional fee per image.
Raw Files: The Photographer does not deliver unedited Raw files under any circumstances.
4. COPYRIGHT & USAGE RIGHTS
Ownership: Dinah Photography retains the copyright to all images created.
Client Usage: Images are licensed to the Client for Personal Use Only (social media, personal prints, gifts). You may not sell, license, or enter the images into contests without written permission.
Social Media: When posting online, a credit to @DinahPhotography is appreciated but not required. You agree not to apply filters or alter the images, as this misrepresents the Photographer’s work.
Commercial Use: If you require images for business use (advertising, branding), a separate Commercial License Agreement is required.
5. MODEL RELEASE
Promotion: Unless otherwise agreed in writing, the Client grants the Photographer the right to use images from the session for promotional purposes, including social media, website portfolios, and advertisements.
If you wish to keep your photos private, please notify the Photographer in writing before the session.
6. CONDUCT & LIABILITY
Cooperation: The Photographer is not responsible for photos not taken due to Client lateness or lack of cooperation (e.g., uncooperative children).
Safety: The Photographer is not liable for injuries or property damage occurring during a session.
Equipment Failure: In the unlikely event of technical failure or lost data, the Photographer’s liability is limited to a full refund of any fees paid.
7. DELIVERY
Turnaround Time: Proofs/Galleries will be delivered within 1-2 of the session date.
Storage: The Photographer is only responsible for storing images for 3 months after delivery. It is the Client's responsibility to download and back up their files.
8. GOVERNING LAW
These terms shall be governed by the laws of Arizona, USA.
